Terms of Service
1. Acceptance of Terms
By creating an account or otherwise accessing or using TimberSentry ("the Service," "we," "us," "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Service Description
TimberSentry is a SaaS platform that:
- Accepts user-defined timber stand boundaries (polygons drawn in the browser or uploaded as KMZ/KML or Shapefile).
- Periodically queries public Sentinel-2 satellite imagery via the Copernicus/ESA STAC API to compute vegetation indices including NDVI, NDMI, LAI Proxy, and BSI.
- Issues automated "health verdict" notifications based on threshold rules applied to those indices.
- Monitors NASA FIRMS active-fire data and sends fire-proximity alerts when hotspots are detected within a configurable radius of registered stands.
- Provides optional compliance documentation modules for EUDR (EU Deforestation Regulation), SFI (Sustainable Forestry Initiative) audit reports, and ATFS (American Tree Farm System) monitoring logs.
- Generates downloadable PDF reports summarising stand health history.
3. Satellite Data Limitations
You acknowledge and accept the following inherent limitations of satellite-derived analysis:
- Cloud cover: Sentinel-2 is an optical sensor. Cloud contamination can prevent valid readings; scans may be skipped or return null values during prolonged cloud cover.
- Revisit frequency: Imagery acquisition follows Sentinel-2's orbital schedule, approximately every 5 days at the equator and less frequently at higher latitudes. Our processing pipeline runs on a best-effort weekly schedule and may lag behind new acquisitions.
- Minimum stand size: Very small stands (generally under 1 acre) may produce unreliable spectral averages due to mixed pixels at Sentinel-2's 10 m resolution.
- Detection accuracy: Algorithmic thresholds can produce both false positives (flagging healthy stands) and false negatives (missing real damage). Indices are statistical proxies, not direct measurement of timber condition.
- Not a replacement for site visits: TimberSentry outputs should be used to prioritise and guide on-the-ground inspections, not to replace them. We strongly recommend verifying any flagged condition in the field before making management or legal decisions.
3.1 External Data Sources & Force Majeure
TimberSentry depends on third-party public data providers (including but not limited to NOAA, NASA, USDA, NIFC, and ESA/Copernicus). These providers are outside of our control and may change availability, formats, or access policies at any time. We will use commercially reasonable efforts to adapt to such changes, but we do not guarantee continuity of any third-party feed.
To the extent permitted by applicable law, TimberSentry shall have no liability for any delay, loss, or failure of the Service caused by third-party outages, changes to third-party terms, force majeure events (including but not limited to natural disasters, satellite failures, war, strikes, government actions, or internet backbone outages), or any circumstances beyond our reasonable control.
4. Compliance Modules Disclaimer
The EUDR, SFI, and ATFS modules within TimberSentry are documentation-assistance tools. They help you record observations and generate formatted log entries. They do not:
- Constitute certification of compliance with EUDR, SFI, ATFS, or any other regulatory framework.
- Provide legal advice regarding your obligations under applicable deforestation due-diligence regulations.
- Guarantee acceptance by any certification body, government authority, or supply-chain auditor.
You remain solely responsible for ensuring your operations comply with applicable laws and certification standards. Consult qualified legal and forestry professionals for compliance decisions.
5. Accounts and Security
- You must provide accurate registration information and keep it current.
- Each permitted user may hold only one active personal account unless otherwise authorised in writing by TimberSentry. Multiple accounts to avoid limits, abuse promotions, or bypass security restrictions are prohibited.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must not share accounts, resell access, or use automated scripts to circumvent usage limits.
- Social login: You may sign up or sign in using third-party identity providers (for example, Google Sign-In). By using social login you authorise TimberSentry to receive the provider information you allow (email address, profile name, and unique identifier). We use those details only to create or authenticate your account; we do not post to your social accounts without separate consent.
- Notify us immediately at the contact address below if you suspect unauthorised access to your account.
5.1. Abuse and Prohibited Conduct
- Accounts may not be used for abusive behavior including fraud, impersonation, data scraping, or attempts to overload, tamper with, or breach the Service or its backend data feeds.
- Violation of these rules may result in immediate suspension or termination of accounts and revocation of any promotions or credits.
6. Subscription and Billing
- Plans: TimberSentry offers a Free plan and a paid Pro plan. Plan features and pricing are described at /pricing and are subject to change with advance notice.
- Billing cycle: Paid subscriptions are billed monthly in advance via Stripe. Your subscription renews automatically unless cancelled.
- Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; we do not issue pro-rata refunds for partial months.
- Data retention after cancellation: Stand boundaries, scan history, and compliance records are retained for 90 days following cancellation or account deletion, after which they are permanently deleted. You may export your data at any time while your account is active.
- Payment processing: All payment processing is handled by Stripe, Inc. TimberSentry does not store credit card numbers or sensitive payment data on its servers.
- Upgrades/downgrades: Upgrading takes effect immediately; downgrading takes effect at the next billing cycle. If a downgrade would cause your active stands to exceed the lower plan's limits, the excess stands will become read-only until you remove them or upgrade.
7. Acceptable Use
You agree not to use the Service to:
- Upload stand boundaries over land to which you have no legitimate monitoring interest.
- Transmit malicious code, attempt to breach the Service's security, or reverse-engineer the platform.
- Use the Service in any manner that violates applicable local, state, national, or international laws.
- Scrape, resell, or sublicense Service outputs or API access without our written permission.
8. Intellectual Property
- Your data: You retain all rights to the stand boundary polygons and other data you upload or create within the Service.
- Our platform: The TimberSentry software, algorithms, branding, and documentation are the exclusive property of the operator. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose while your account is active.
- Satellite imagery: Sentinel-2 imagery is sourced from the European Space Agency / Copernicus programme under open data licences. TimberSentry processes this data but does not own it.
- Reports: You may use PDF reports and exported data for your own internal business and compliance purposes.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or that any specific satellite scan will be successfully acquired on any given date.
- In no event shall TimberSentry, its officers, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, timber value, or business opportunity, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.
- Our total aggregate liability to you for any claim arising from or relating to these Terms or the Service shall not exceed the total amounts paid by you to TimberSentry in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless TimberSentry and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party right.
11. Third-Party Services
The Service integrates with third-party providers including Stripe (payment processing), the ESA/Copernicus STAC API (Sentinel-2 imagery), and NASA FIRMS (fire alert data). Your use of these integrated services is additionally subject to the respective providers' terms:

12. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we determine that you have violated these Terms, if required by law, or if continued service is not technically feasible. Upon termination, your licence to use the Service ceases immediately. Sections 8, 9, 10, and 13 survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email or in-app notification at least 14 days before material changes take effect. Your continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms. If you disagree with the changes, you must cancel your account before the effective date.
